Default Would publishing protect?

Would original but un-copyrighted poetry published in an anthology be proof enough to establish property rights?

Someone wouldl need to get permission before republishing them according to intellectual property laws. It gets stick if the published passes away, then which permission would need to be granted from the current estate.
