Probably the most important step to find out if malpractice really occurred. This is a very specific area of law where you will need to consult an attorney who will then decide whether or not to take your case. These cases are often very expensive because there are a lot of issues involved, as well as medical experts and their expert testimony. Also don't forget that hospitals have very expensive attorneys who will do anything to protect their image. You will need to find an attorney who is willing to take your case on a contingency fee unless you can afford all those fees.

I expect that many hospitals and doctors have deep pockets when it comes to fighting their legal battles.

It sounds like an ounce of prevention is worth a pound of cure in the possible legal battles as well.

I worked in a clinic where one of the doctors was charged with malpractice. Not only did she have access to very good lawyers, the clinic sent her away for a long weekend at a beach house, so she could calm down once she found out she'd been charged.
